1.1 The present sales terms and conditions (hereinafter the terms and conditions) of AS Tootsi Turvas (hereinafter the seller) are valid for all legal and physical persons (hereinafter the buyer) who purchase goods and services (hereinafter the goods) from the e-shop of the seller.
1.2 The terms and conditions form an inseparable part of the agreement concluded between the seller and the buyer.
1.3 In the meaning of these terms and conditions, a consumer is a physical person who makes a transaction which is not related to carrying out independent economic or professional activities.
1.4 The seller is entitled to change the present terms and conditions. All the changes are reflected at the website tootsiturvas.ee/2020.
2.1 The prices indicated in the seller’s e-shop price list are valid for the buyer. The prices include VAT.
3.1 Click on “ORDER PRODUCTS” and choose a product or products.
3.2 Click on “Add to cart” (a confirmation about adding the products to the cart is displayed).
3.3 Click on “Cart” and then “View cart”.
3.4 If necessary, click on “Update cart” to change the products in the cart.
3.7 Click on “Proceed to checkout”.
3.8 Fill in the contact information under “Buyer details” (fields marked with an asterisk are mandatory) – email address, first and surname, company name, country, address, postal code, city, telephone.
3.10 Click on “I have read and agree to the terms and conditions” and then “Submit order”.
3.11 You will be directed to a page where you can choose your bank.
3.12 After paying for the goods, a confirmation of the purchase is sent to your email address.
3.13 Orders placed in the e-shop will be handled on business days Mo–Fri from 8 a.m. to 4 p.m. If an order is placed on Friday after 2 p.m. or on a national holiday, the order will be handled on the following Monday or on the first business day after the national holiday.

If the seller cannot perform the order and the buyer has already made a prepayment for the goods, the seller contacts the buyer and returns the paid sum immediately but no later than within 5 days.
4.1 The seller undertakes to hand the goods over to the buyer and to make the transfer of the ownership of the goods to the buyer possible.
4.2 Orders which are not paid for will be cancelled on the business day following the day such order was placed.
4.3 The sales agreement enters into force upon the accrual of the buyer’s payment to the e-shop bank account of the seller.
4.4 The seller is entitled to, without any sanctions, withdraw from the sales agreement concluded via the e-shop if:
4.4.1 the price or properties of the goods are displayed incorrectly in the e-shop due to a system error;
4.4.2 the buyer does not meet the terms and conditions established by the seller.
5.1 The buyer undertakes to pay to the seller the sum indicated on the invoice of the goods.
5.2 The buyer undertakes to receive the goods from the seller in the place and at the time previously agreed upon.
5.3 The buyer undertakes to bear the shipping costs of the goods.
6.1 Goods can be handed over in different ways:
6.1.1 the courier delivers the goods to the delivery address indicated in the buyer’s order.
6.1.2 the buyer can collect the goods from the warehouse the address of which is indicated in the e-shop.
6.1.3 The delivery time of goods is 1 to 2 weeks.
6.2 The delivery deadlines of goods indicated at the website of the e-shop are valid from the moment the e-shop has received the sum of the buyer’s order to its bank account.
7.1 The ownership of the goods is transferred to the buyer when the goods are handed over to the buyer.
7.2 The risk of accidental destruction and damage is transferred to the buyer when the goods are handed over to the buyer.
7.3 When using transport services, the risk of accidental destruction and damage is transferred to the buyer from the moment the goods are handed over to the carrier, except in the event of consumer sales.
7.4 The risk of accidental destruction and damage is also transferred to the buyer at the time the buyer delays the process which should contribute to the handover of goods, especially when they do not accept the goods.
8.1 A consumer is entitled to return the goods in 14 days since the goods were handed over to the consumer.
8.2 To return the goods, the consumer sends a free-form application of withdrawal and the documents related to the purchase to the email address of the seller myyk@tootsiturvas.ee no later than in 14 days since the handover of goods. The application of withdrawal should include: the order number, product code, name and quantity, and the reason of withdrawal.
8.3 The goods can be returned ONLY if the commercial appearance of the goods has been maintained, including an intact film package of peat and soil products, the labels on the package are preserved and the product has not been used.
8.4 The seller returns to the consumer the sum paid by the consumer, except the shipping costs of the goods, in 14 days since the application of withdrawal was received by the seller.
8.5 If the consumer withdraws from the agreement, the return costs of the goods will be borne by the consumer.
8.6 If the buyer cannot return the non-compliant goods by using 14-days right of withdrawal, the buyer is entitled to use the legal right to file a claim.
