1. General provisions
1.1 The present sales terms and conditions (hereinafter the terms and conditions) of AS Tootsi Turvas (hereinafter the seller) are valid for all legal and physical persons (hereinafter the buyer) who purchase goods and services (hereinafter the goods) from the e-shop of the seller.
1.2 The terms and conditions form an inseparable part of the agreement concluded between the seller and the buyer.
1.3 In the meaning of these terms and conditions, a consumer is a physical person who makes a transaction which is not related to carrying out independent economic or professional activities.
1.4 The seller is entitled to change the present terms and conditions. All the changes are reflected at the website tootsiturvas.ee.
2. Sales price
2.1 The prices shown on the website are indicative; the final price valid for the buyer is confirmed in the seller’s offer and on the invoice. The prices include VAT.
3. How to buy
3.1 Choose a product and fill in the order form on the product page. There is no shopping cart and no online payment on the website.
3.2 Fill in the contact details (fields marked with an asterisk are mandatory) – name, email address, telephone, quantity and any other relevant information.
3.3 Click on “Submit”. A confirmation that your enquiry has been received is sent to your email address.
3.4 The sales manager checks the availability of the product, agrees with the buyer on the quantity, price, loading place and time, and sends the invoice by email.
3.5 Payment is made by bank transfer on the basis of the invoice. The website does not mediate payments and does not process the buyer’s bank details.
3.13 Orders placed in the e-shop will be handled on business days Mo–Fri from 8 a.m. to 4 p.m. If an order is placed on Friday after 2 p.m. or on a national holiday, the order will be handled on the following Monday or on the first business day after the national holiday.

If the seller cannot perform the order and the buyer has already made a prepayment for the goods, the seller contacts the buyer and returns the paid sum immediately but no later than within 5 days.
4. Rights and obligations of the seller upon the performance of the sales agreement
4.1 The seller undertakes to hand the goods over to the buyer and to make the transfer of the ownership of the goods to the buyer possible.
4.2 Orders which are not paid for by the due date indicated on the invoice are deemed cancelled, unless the parties have agreed otherwise.
4.3 The sales agreement enters into force when the seller has confirmed the order by email and the buyer has paid the invoice, unless agreed otherwise.
4.4 The seller is entitled to, without any sanctions, withdraw from the sales agreement concluded via the e-shop if:
4.4.1 the price or properties of the goods are displayed incorrectly in the e-shop due to a system error;
4.4.2 the buyer does not meet the terms and conditions established by the seller.
5. Rights and obligations of the buyer upon the performance of the sales agreement
5.1 The buyer undertakes to pay to the seller the sum indicated on the invoice of the goods.
5.2 The buyer undertakes to receive the goods from the seller in the place and at the time previously agreed upon.
5.3 The buyer undertakes to bear the shipping costs of the goods.
6. Handover of goods
6.1 Goods can be handed over in different ways:
6.1.1 the courier delivers the goods to the delivery address indicated in the buyer’s order.
6.1.2 the buyer can collect the goods from the warehouse the address of which is indicated in the e-shop.
6.1.3 The delivery time of goods is 1 to 2 weeks.
6.2 The method and deadline of handover are agreed upon when the order is confirmed.
7. Transfer of ownership and risk of accidental destruction and damage
7.1 The ownership of the goods is transferred to the buyer when the goods are handed over to the buyer.
7.2 The risk of accidental destruction and damage is transferred to the buyer when the goods are handed over to the buyer.
7.3 When using transport services, the risk of accidental destruction and damage is transferred to the buyer from the moment the goods are handed over to the carrier, except in the event of consumer sales.
7.4 The risk of accidental destruction and damage is also transferred to the buyer at the time the buyer delays the process which should contribute to the handover of goods, especially when they do not accept the goods.
8. Consumer’s right to withdraw from the agreement
8.1 A consumer has the right to withdraw from the agreement and return the goods within 14 days of the goods being handed over to the consumer.
8.2 To return the goods, the consumer submits a notice of withdrawal using the form on our website (tootsiturvas.ee/en/shop/contract-withdrawal/) or in free form, together with the documents proving the purchase, to the seller’s e-mail address myyk@tootsiturvas.ee.
8.3 The seller refunds to the consumer the price of the goods and the initial ordinary delivery cost within 14 days of receiving the notice of withdrawal. The seller has the right to withhold the refund until the goods have been returned or until the consumer has provided proof that the goods have been dispatched. The refund is made to the bank account provided by the consumer in the notice of withdrawal. If no account has been provided, the method of refund is agreed by e-mail.
8.4 The consumer bears the direct costs of returning the goods, unless the parties have agreed otherwise.
8.5 The right of withdrawal does not apply if the goods have been installed or used to a greater extent than is necessary to establish their nature, characteristics and functioning, and this makes it impossible to resell the goods in their original condition.
8.6 Return of heavy goods
Goods whose individual package or consignment weighs more than 500 kg (for example peat on pallets, big bags and other similar products) are considered heavy goods. The consumer has the right to return heavy goods within 14 days in accordance with clauses 8.1–8.4 of this chapter. The direct costs of returning heavy goods (including loading, lift truck, courier service etc.) are borne by the consumer. The exact method and return address of heavy goods are agreed with the seller depending on the product, in a form that can be reproduced in writing (by e-mail), whereby the seller is not obliged to arrange the collection of heavy goods from the consumer’s location.
